The Supreme Court of Canada’s recent decision in R. v. Greater City of Sudbury, sent shockwaves through the procurement and contractor communities. On August 23, 2024, an appeal court applied the SCC decision, to uphold the trial findings that – although the City was an “employer” within the meaning of OHS legislation, it had established the defence of due diligence by taking reasonable precations as an owner-employer. This ruling affirms a common-sense and principled, contextual approach to owner-employer project due diligence, which provides a roadmap for all industry stakeholders.

In this session, you will hear from OHS lawyers, Ryan Conlin and Jeremy Schwartz, Partners at Stringer LLP, who represented the City of Greater Sudbury in this saga, as well as hear from Roger Tickner, President of Tickner & Associates and Tickner Brooks Professional Corporation, and members of his team, about the practical ‘on-the-ground’ implications and opportunities for all stakeholders to better ensure safety and compliance.
